Federal Judge Issues Nationwide Injunction Against ATF’s Pistol Brace Ban

A federal judge in Texas has issued a nationwide injunction blocking the enforcement of a Biden administration rule that redefines pistol braces as short-barreled rifles (SBRs).

The ruling by Judge Matthew J. Kacsmaryk in the Northern District of Texas follows a previous injunction granted specifically to Texas Gun Rights members in their lawsuit against the ATF.

The controversial ATF rule, targeting stabilizer braces on AR-pistols, was challenged by plaintiffs, including a disabled veteran, who argued that the rule infringed on their rights and would cause irreparable harm.

Judge Kacsmaryk’s decision emphasized that while public safety concerns are valid, regulatory measures must be lawful, concluding that the ATF’s rule on pistol braces does not meet this standard. The nationwide injunction effectively halts the enforcement of the rule for all gun owners.
